Amity releases Cpl. Oesterling

Following a Local Agency Police Tenure Act Hearing on Sept. 10, the Amity Township Board of Supervisors unanimously approved on Sept. 18 to terminate Amity Police Cpl. Glenn A. Oesterling, effective immediately.

Township Solicitor Brian F. Boland said Oesterling would be notified by certified mail.

Supervisor Richard L. Gokey was absent from the meeting.

Oesterling, a 12-year veteran of the police force, was charged in July for two incidents of retail theft and receiving stolen property.

He was subsequently suspended without pay.

Boland said the Board of Supervisors had found the evidence of the charges credible and convincing.

The board authorized for Board Chairperson Kimberly J. McGrath to meet with township officials to “hear what he has to say” regarding optional ambulance services.

Durso indicated in a letter to Amity Township that he is considering finding another ambulance company “since Southern Berks EMS is not doing well financially.”

A federal tax lien in the amount of $71,447.38 has been filed against Southern Berks Regional Emergency Medical Services, Reading.

The board unanimously approved to waive the formal land development review process for Hess Corp., New York, NY, and agreed to an in-house review.

Officials from Hess said they seek to improve passenger vehicle and truck refueling by relocating the gasoline and diesel fueling stations for improved truck accessibility.

The pump relocation would also result in moving a canopy into the state right-of-way.

Hess’ zoning board hearing on Sept. 16 (to obtain a dimensional variance) was continued in order for company officials to redesign their land development plans.

A neighbor said Hess’s improvements would be an inconvenience to them with increased truck noise, headlights, and that the canopy would block their view.

The land development plan was redesigned to include arborvitae plantings and a six-foot vinyl fence that would match the neighbor’s fence.

Hess officials said the fence would block the headlights but said there wouldn’t be any more or less truck noise; Hess will continue to be a pass-by business and not a destination business.

The new plan will be presented to the Zoning Board at its Oct. 21 meeting.

“They own a house on a highway and there’s no piece of mind at night ,” said Supervisor Terry L. Jones, adding, “But now there will be a security issue back there . Buffers are nice but they grow.”

Board members agreed that the fence and plantings would create a security issue and are not required by Hess to install.

“Perception is everything,” said a Hess official, “and we would like to be perceived as good neighbors.”

The board also gave conditional preliminary approval to the Blacksmith subdivision, Blacksmith and Old Swede roads.

Blacksmith would be a subdivision of 18 semi-detached units on 5.1 acres that contains two existing stone farmhouse structures.
