A Fleetwood man is accused of assault and making terroristic threats.

Fleetwood Borough Police Chief Steven Stinsky reports that in the late evening hours of Aug. 19, Brian Sacks, Fleetwood, became involved in a verbal argument with his wife which culminated in him forcing her to leave the residence without taking any personal belongings.

The female victim was in the area of Church Hill Road and Moselem Springs Road in Richmond Township where she was observed by an 18-year-old man who was driving by as he returned from work.

Seeing she was upset he stopped to offer assistance at which point the accused (Sacks) is alleged to have come speeding up to their location where he exited his vehicle and retrieved a pistol from the trunk area of his car. The accused is then said to have angrily approached the male victim and while pointing the pistol at his chest and face demanded to know where the female victim had gone.

The male victim seized an opportunity to escape when Sacks was distracted and got into his vehicle and sped off. The victim telephoned 911 from a local restaurant to advise police what had happened.

Sacks returned to his residence with the pistol and locked himself in the house. Officers surrounded the residence and negotiated his arrest without incident.

A loaded .45 caliber pistol matching the description provided by victims and registered to Sacks was seized from the residence along with an empty holster containing a full magazine of .45 caliber ammo which was seized from his vehicle.

Sacks was released to the Berks County Sheriff’s Office for processing and subsequently committed to Berks County Prison in lieu of $10,000 cash bail.

Officers from Northern Berks Regional Police Department, Kutztown Borough Police Department and the PA State Police assisted during this incident.
